Canon law and the national laws of Norway and Sweden, c.
1270–1360
The Norwegian (1274) and Swedish (c. 1350) national laws lack a section on
ecclesiastical law, unlike earlier provincial laws. Historians have sought an
explanation in the conflicts between kings and bishops about the laws’ contents. In this article, I re-examine the sources and argue that the usual narrative rests on over-interpretation: in a broader European context, it was
normal to exclude ecclesiastical law from secular law books, since the church
possessed its own law books in the Corpus iuris canonici.
In Norway, evidence for the supposed clash between King Magnus Lagabøte and Archbishop Jon Røde at a local assembly in 1269 is limited. The
key source does not support the idea of an open quarrel. Likewise, the agreements of 1273 (Bergen) and 1277 (Tønsberg), traditionally read as peace treaties concluding serious conflict, do not support such an interpretation. They
clarified the boundaries between secular and ecclesiastical jurisdiction in
terms consistent with canon law and widely accepted.
In Sweden, the standard explanation for why Magnus Eriksson’s national
law had no section concerning church law (kyrkobalk) hinges on a protest
in 1347 by five cathedral canons. This event has not previously been read as
a formal protestatio. The canons simply reserved all rights and privileges of
the church against any changes in the new secular law book. Additionally,
the canons protected themselves from appearing to have consented to provisions – such as capital punishment – that clerics were forbidden to endorse
under canon law.
I contend that the real reason why the national laws lacked a section on
church law lies in the European system of ecclesiastical jurisdiction. By the
thirteenth century, church courts handled matters previously covered by
the provincial church law texts. In most of Latin Christendom, secular law
books no longer summarised this material. Thus, the early Scandinavian
provincial laws with their ecclesiastical sections were instead the exception,
not the rule. The repeated copying of the old church law sections reflected
their enduring cultural prestige and practical use rather than any continuing
role as sources of law.

This chapter argues that Western European legal culture became increasingly standardized from the twelfth century, giving raise eventually to the relative uniformity of modern law. Law schools and the papacy were key actors in creating the system of law known as the ius commune, but it is argued that the example of regularly meeting church law courts was pivotal in spreading that law across Europe. The chapter focuses on marriage law and legal procedure, and it compares individual church court cases from thirteenth-century Italy and fourteenth- century Norway, demonstrating their basic similarity in their use of both substantial and procedural law. Some examples from secular law show how that law adapted as well as resisted features of the ius commune, worked out in the law schools and applied in the church courts. The chapter ends with a few reflections on Max Weber’s legal sociology and how it illuminates late medieval standardizing movements in Europe.

The author proposes to edit the first recension of Gratian’s Decretum on the basis of the seven known witnesses
to that recension in addition to about six second-recension manuscripts selected to capture as many variants
as possible. The formal source(s) must also be collated. Given that the manuscript tradition of the work is
greatly contaminated and thus impossible to analyze stemmatically, the editorial work must focus on working
out the relationship among textual variants rather than among codices.

The century between c. 1130 and 1234 was a time of great renewal and transformation in canon law when much of the foundation was laid that would define the legal structure of not only the church but also secular society well into modern times (see Chapter 30). At this time, papal legislation found its stride, in the form of papal decretals and conciliar decrees (notably from the four Lateran councils, 1123–1215). The inhabitants of Europe sought out the pope’s judicial decisions in unprecedented masses, creating a rich body of papal case law. At the same time, legal study grew exponentially at the law schools, particularly in Bologna, where an expanding and often innovative tradition of analysis and commentary, which were also inspired by the recently rediscovered Roman law of the emperor Justinian, brought canon law to new levels of complexity, sophistication, and precision.

Law schools flourished in the Byzantine Empire at the beginning of the Middle Ages, notably in Constantinople and Beirut. They taught, in Latin, the law of the Roman Empire, which also regulated the affairs of the Church (see Chapter 9). The reign of Justinian (527–65) brought the new compilations of law later known collectively as the Corpus iuris civilis (see Chapter 13) and soon also a shift of the language of instruction to Greek. Legal education, including teaching of eastern canon law, continued practically as long as the Empire survived, and beyond, producing notable scholars of canon law, such as John Zonaras (fl. early twelfth century) and Theodore Balsamon (d. after 1195) (see Chapter 9).

The Decretum Gratiani is the cornerstone of medieval canon law, and the manuscript St Gallen, Stiftsbibliothek, 673 an essential witness to its evolution. The studies in this volume focus on that manuscript, providing critical insights into its genesis, linguistic features, and use of Roman Law, while evaluating its attraction to medieval readers and modern scholars.
Together, these studies offer a fascinating view on the evolution of the Decretum Gratiani, as well as granting new insights on the complex dynamics and processes by which legal knowledge was first created and then transferred in medieval jurisprudence.

Abstract Gratian of Bologna, later bishop of Chiusi (died c. 1145), was a remarkably influential lawyer, who is undeservedly little known today. He was a legal expert who specialized in the rules and regulations of the Western Christian church. In around 1140, he put together a law book known as the Decretum, which became a great success, remaining foundational for medieval and modern law. The article focuses on three legal areas: tithes, marriage, and natural law. It discusses how Gratian used scholastic methods and classroom exercises to come to grips with the many contradictions that existed in the more than ten centuries of law that he strove to collect and synthesize. It highlights how Gratian’s innovations in marriage law, natural law, and procedural law still influence modern law. Gratian left Bologna before he had finished the course, and the article reflects on the differences in his later fate and that of his book.

The article argues that Belgsdalsbók (AM 347 fol.: Jónsbók and other texts) may have been the law book that was listed as “damaged” in the 1525 inventory of the property of Hólar bishopric. Three reasons suggest this conclusion. First, its earliest known owner was Steinunn Jónsdóttir, the daughter-in-law of the last Catholic bishop of Hólar. Second, its date and circumstances of production suggest that Bishop Jón Eiríksson skalli might have been its commissioner. Third, Belgsdalsbók contains unusual texts of interest to an ecclesiastical owner. In addition, the article suggests that another copy of Jónsbók, GKS 3269 a 4to, may also have belonged to Hólar bishopric.

In the Middle Ages, much like today, long distances were not insurmountable obstacles. People travelled far and wide to venerate relics, seek education, join military campaigns, contract marriages, and engage in trade. As people moved, so did also material artefacts – merchandise, liturgical objects, diplomatic gifts, and books – as well as immaterial ones – ideas, technologies, news, and laws. Norway was as much a destination for these human, material and immaterial travellers as any other region. Some, but not all of these “travellers” left lasting marks. Longevity was reserved for those that resonated with critical local needs. Even then, however, travellers were typically transformed by the cultural landscape of their destination.
From the thirteenth century onwards, Scandinavia received such travellers on a previously unprecedented scale. Drawing from a range of sources, such as legal texts, romances, and visual objects, this talk explores how both the travellers and Norway changed with these interactions. We consider which social chords these encounters struck and how processes of integration and adaptation followed, shaping Norway as the Middle Ages ended.
