The United States’ government and private organizations played key roles in the international breakthrough of human rights that took place in the aftermath of World War II. This dissertation locates visions of human rights within the evolution of American legal culture and foreign policy. It also locates such visions within the broader international context and its linkages with the search for a “durable peace” after World War II and the creation of the United Nations and the early years of the Cold War.
The dissertation is based on research in a variety of archives. It utilizes unpublished internal government papers of the Department of State, inter-departmental working groups as well as the American Delegation to the United Nations. Furthermore, several collections of personal papers of eminent American legal scholars and private organizations have been scrutinized, the most important being the papers of The American Law Institute and the Carnegie Endowment for International Peace. These have been supplemented by a large collection of published materials, including the many American legal journals.
It has 7 chapters and is written as a chronological narrative. Most of the chapters provide detailed discussions of the internal deliberations and contributions by the different groups of individuals who were involved in defining international human rights and measures for their implementation, within and outside the United States’ government. Chapter 2 provides a historiographic discussion and an introduction to the main actors of the American legal community. Chapter 6 argues that the United States faced constitutional challenges that curbed its desire to take the lead on human rights in the United Nations. These underpinned many of the United States’ controversial positions related to the project of drafting an international bill of rights, in particular its ambiguous attitude on the proposed human rights convention(s).
